Esquivel & Martin Santos (formerly known as EMPS) is a boutique full-service intellectual property firm based in Madrid, Spain. We can represent our clients before Spanish and European courts and authorities.
We work with both Spanish and international clients in a range of industries, from fashion to food and beverage, from pharma to entertainment.
We are different to other firms and this is reflected in two commitments:
- Every step of every file is entrusted to highly specialised lawyers and chartered patent and trademark attorneys. There is no such thing as minor aspects in our client's files.
- Every service is charged at a fixed fee. Our clients deserve to be able to assess their strategy and budget beforehand, that's why we don´t do hour billing, including litigation files.

Victoria Sofía Martín
Adrian has over 15 years' experience advising on intellectual property law, trademark and patent prosecution. He co-founded the firm 8 years ago.
He supervises over 3,000 files before the Spanish Trademark Office, WIPO, the European Patent Office (EPO) and the EUIPO.
He holds a Master in Laws in Intellectual Property law by Universidad Alicante, (Spain) and his Bachelor in Laws by Universidad de Costa Rica.
He was recipient of a USAID fellowship in Washington DC.
Adrian is a member of INTA; ASIPI, ECTA; Spanish group of AIPPI and FICPI. He is also member of the Geographical Indications Committee and the Trade Dress and Industrial Design Commitee of the Asociación Interamericana de la Propiedad Intelectual.
He has published articles in Intellectual Property Magazine and Derechos Intelectuales (ASIPI).
Adrian is fluent in Spanish and English.
Victoria Sofia has been working in the field of intellectual property for the last 12 years. She is an attorney admitted to practice in Spain (Madrid bar) and an official patent and trademark agent (charter number 1000/6). She co-founded the firm 8 years ago.
She's specialised in intellectual property and unfair competition litigation before Spanish and European courts and administrative bodies.
She holds a Master in Laws in Intellectual Property law by Universidad Alicante, Spain, and her Bachelor in Laws by Universidad Pontificia (ICADE) in Madrid. She also spent a year abroad at the law faculty of the Université Libre de Bruxelles.
She is a judicial expert in intellectual property matters and an occasional speaker and media commentator on intellectual property issues. She has published several influenftial articles in the EU Unfair Competition Gazette (in Spanish).
She was awarded the distinction Intellectual Property Lawyer of the year - Spain by Finance Monthly Legal Awards 2020.
Victoria Sofia is fluent in Spanish, English and French.
